CC-96-027: Applicability of Land Disposal Restriction Standards to Decharacterized Hazardous Wastes in Surface Impoundments
Enclosed please find material published in the Federal Register on April 8, 1996. In it, EPA promulgates rules implementing the Land Disposal Program Flexibility Act of 1996, which states that hazardous wastes which are hazardous only because they are identified as exhibiting a characteristic are not prohibited from land disposal (including placement in a surface impoundment) if they are managed in a treatment system whose discharge is regulated under the Clean Water Act, provided that the wastes are no longer hazardous at the point land disposal occurs.
