Attached is material that appeared in the April 17, 2002 Federal Register. It is revised EPA guidance on the definition of “federally permitted releases” as it pertains to emissions that may be subject to CERCLA Section 103 and/or SARA Section 304 reporting requirements. This guidance will mainly be of interest to facilities that have emissions of gaseous compounds that appear on the CERCLA list of “hazardous substances” and/or the SARA list of “extremely hazardous substances.” Such compounds include acrolein, ammonia, benzene, chlorine, chloroform, formaldehyde, hydrogen sulfide, methanol, MEK, nitric oxide, nitrogen dioxide, phenol, sulfur dioxide, sulfur trioxide, and sulfuric acid.
